3. COLLECTING AND STORING OF PERSONAL DATA AS WELL AS TYPE AND PURPOSE OF USE
a) When visiting the website
When accessing our website, www.echte-liebe.com, the browser used on your terminal device automatically sends information to our website’s server. This information is temporarily stored in a so-called log file. Without any action on your part, the following information is captured until it is automatically deleted:

• date and time of access;
• name and URL of retrieved file;
• website used for access (referrer URL); and
• browser used and, if necessary, your computer’s operating system and your access provider’s name. We process the specified data for the following purposes:

You have the option of contacting us for questions of any kind by using a form provided on this website. It requires entering a valid e-mail address to let us know who the request comes from, so we can reply to it. Other information can be added on a voluntary basis.
c) When using our newsletter

This does not apply to data we obtained by other means than your registration.
5. USAGE RIGHTS
5.1 Both parties remain the owners of the usage rights they are entitled to. Echte Liebe is granted usage rights to the marketing materials provided by the customer only insofar as they are required for fulfilling the placed order. The customer acquires no usage rights to the technologies used by Echte Liebe.
5.2 Once the order is placed, Echte Liebe assumes ownership of all the data obtained as part of campaigns. This includes data acquired as described in Clause 4.2. Provision of such data to the customer is at Echte Liebe’s discretion.

Your personal data are shared with third parties only for the purposes listed below. We share your personal data with third parties only if:
• you have given your express consent according to Art. 6 Para. 1 S. 1 lit. a GDPR;
• sharing your data according to Art. 6 Para. 1 S. 1 lit. f GDPR is required to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data;
• sharing your data according to Art. 6 Para. 1 S. 1 lit. c GDPR is legally stipulated; and
• it is legally permitted and, according to Art. 6 Para. 1 S. 1 lit. b GDPR, required to fulfil our contractual relationships with you

6. ANALYTICS TOOLS
a) Tracking tools
The tracking methods listed below and used by us are based on Art. 6 Para. 1 S. 1 lit. f GDPR. The tracking methods used are designed to ensure an on-demand design and continuous optimization of our website. On the other hand, we use the tracking methods to statistically capture the use of our website and to analyze it to optimize our offering for you. These interests are to be considered as legitimate in terms of the regulation mentioned above. Please see the relevant tracking tools for the respective data processing purposes and data categories.
i) Google Analytics
For an on-demand design and continuous optimization of our pages, we use Google Analytics, a web analytics service by Google Inc. (https://www.about.google) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter referred to as “Google”). In this context, pseudonymized user profiles are created and cookies (see Clause 5) are used. The cookie generates information about your use of this website, including
• browser type / version;
• operating system used;
• referrer URL (the previously visited page);
• host name of the accessing computer (IP address); and
• time of the server request;
which is transferred to a Google server in the US and stored there. The information is used to analyze how the website was used to compile reports on website activities and to provide further services connected with the use of the website and the Internet usage formarket research and on-demand design of these web pages.
This information is also shared with third parties if this is required by law or as far as these third parties are contracted to process these data. Under no circumstances is your IP address merged with other Google data. The IP addresses are anonymized to make correlations impossible (IP masking). You can prevent cookies from being installed by configuring your browser software accordingly. However, we would like to point out that in this case it may not be possible to use all features of this website to their full extent.

ii) Google Adwords conversion tracking
To statistically capture the use of our website and to analyze it to optimize our website, we also use the Google conversion tracking, where Google Adwords places a cookie (see Clause 5) on your computer if you got to our website through a Google ad.
These cookies expire after 30 days and are not used to identify individuals. If a user visits certain pages of the Adwords customer website while the cookie has not yet expired, Google and the customer can recognize that the user has clicked the ad and was redirected to that page.
Every Adwords customer has their own cookie. As a result, cookies cannot be tracked across the websites of Adwords customers. The information collected through the conversion cookie is used to compile conversion statistics for those Adwords customers who have opted in to conversion tracking. Adwords customers find out the total number of users who clicked their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.
If you want to opt out of the tracking process, you can refuse to have the cookie necessary for it stored, such as via a browser setting, to disable the automatic creation of cookies in general. 8. REMUNERATION AND PAYMENT TERMS
8.1 In the event that an advance payment was agreed, Echte Liebe is not obligated to fulfil the order until full payment has been received.
8.2 After executing an order, Echte Liebe issues an invoice to the customer using the invoice address specified in the order. The collection procedure and reporting used by Echte Liebe are authoritative for invoicing.
9. DATA PROTECTION AND DATA SECURITY
Both parties bear sole responsibility for complying with relevant applicable data protection regulations. Insofar as Echte Liebe also works as a contractor of order processing in terms of Art. 28 GDPR on behalf of the customer, both parties conclude, on conclusion of these T&Cs, the order processing agreement enclosed as Annex 1.
7. SOCIAL MEDIA PLUG-INS
Based on Art. 6 Para. 1 Sent. 1 lit. f GDPR, our website uses social plug-ins by the social networks Facebook, Twitter, Instagram and Xing to raise awareness of our company by these means. The underlying promotional purpose is to be seen as a legitimate interest in terms of the GDPR. The relevant providers are to guarantee their responsibility for data protection-compliant operation. We embed these plug-ins using the so-called 2-click method to ensure a maximum of protection for our website visitors.
Our website uses social media plug-ins by Facebook to customize our user experience. To that end, we employ the “LIKE” or “SHARE” buttons. These buttons are a Facebook offering. Use of Hubspot technology
Our website uses the Hubspot service by Hubspot Inc., 25 First Street, Cambridge, MA 02141, USA. We use Hubspot to effectively manage and optimize our online marketing. Hubspot uses so-called “web beacons” and also “cookies”, which are stored on your computer to help us analyze how you engage with our website. Hubspot analyzes the captured information (eg, IP address, geographical location, type of browser, duration of the visit and accessed pages) on behalf of Echte Liebe to generate reports about your visit and the Echte Liebe web pages you visited. To prevent data from being stored and collected by Hubspot cookies, ensure to configure your browser settings accordingly. If you contact us through a contact form or chat and enter your e-mail address in the process, a user account is created, and its communication contents are stored. If you do not enter an e-mail address, no user account is created, and the communication contents are not stored.
